PERM Applications And Labor Certification For U.S. Employment

PERM is an online application for labor certification with the U.S. Department of Labor and is part of the Green Card process. Some employment-based petitions (all EB2 except NIW and all EB3) require that employers obtain a PERM application prior to filing the immigrant petition (I-140). Whether you are an employer petitioning on behalf of a foreign worker or you are seeking employment-based visa in the United States, it is important to know your rights and how to accurately file a PERM application online.

Save Time And Money: File Accurately And Effectively The First Time

At the Law Office of Mark Galvin, we have over 25 years of experience in helping our clients effectively E-File PERM applications and historical paper Labor Certification Applications. We know the legal and practical requirements involving job descriptions and requirements, significance of prevailing wage, recruitment and selection process – and what documentation is necessary and how to ensure that your PERM is filed promptly and accurately.

While the waiting time for paper applications used to exceed 3 or 4 years in some cases, the current processing time for PERM applications (while slower than when PERM was first implemented) is still less than 1 year. With our experience and assistance, you can trust that your application will be filed correctly for faster processing — minimize the chances of a USDOL Audit — and have better assurance that your I-140 petition (Part 2 of Green Card process) will be approved.

PERM Application Assistance For Employers And Employees

Our attorney guides the employer and employee through the various stages of the PERM process which includes preparing the necessary documentation (e.g., job description and requirements, State job order, recruitment materials) — placing State job order and advertisements/postings — and ensuring that we have the correct documentation in the PERM file (e.g., Prevailing Wage Determination, State Job Order, advertising and posting materials, resumes and interview results).

Using state-of-the-art technology, we e-mail the client a draft PERM application for their review, addition and modification. We are very experienced in working with corporations, universities, and other employers as they seek to navigate the immigration law system to obtain a Green Card for an employee.

Employers must comply with the following recruitment requirements for professional occupations other than a college or university teacher using “special handling” procedures (i.e., competitive recruitment and selection process):

  • List the job with State’s workforce commission for 30 days
  • Advertise in a local newspaper of general circulation for two consecutive Sundays (one journal publication can be substituted)
  • Post a job notice at place of employment for at least 10 business days

The employer must also engage in three additional forms of recruitment for professional position which may include employer website, job search website, trade or professional organization, employer referral program, campus placement office, job fair or radio/TV.
